Florida town remembers Trayvon Martin a year after killing

SANFORD, Florida (Reuters) - A year after the shooting death of an unarmed black teenager in this central Florida town, there is a small memorial, a new police chief and an effort to improve race relations.

Trayvon Martin, 17, was gunned down on February 26, 2012, as he walked to his father's fiancee's home in one of Sanford's gated communities. The man accused of his killing, George Zimmerman, 28, a white Hispanic on neighborhood watch, is set to be tried on June 10.

A judge could grant immunity to Zimmerman at a pre-trial hearing on April 29 under Florida's controversial Stand Your Ground law, which allows people to use lethal force in self defense if they are in fear of serious bodily harm.

Martin's death drew top-tier civil rights leaders, such as the Rev. Jesse Jackson and Al Sharpton, who brought a national spotlight to this town just north of Orlando and not far from Disney World.

That spotlight forced the town of 53,000 to confront police work that seemed to be a throwback to the days of separate and resolutely unequal racial sensibilities.

"This situation, with all eyes on Sanford is making them (city leaders) do something about it now," said Cindy Philemon, 49, who helps run the local black heritage museum and welcome center.

A year later Martin's family says it does not want the case considered in racial terms. "We don't want people to see this as a black kid. I want people to see this as a teenager ... who was walking, minding his own business," Martin's mother, Sabrina Fulton, told the NPR radio show "Tell Me More" on Monday night.

Despite the pain of losing her son, Fulton said she was glad that a debate had opened up about Florida's Stand Your Ground law.

The family is backing an amendment to the law seeking to restrict its application. "You can't follow, pursue and chase anyone, be the aggressor, have a confrontation with him, shoot and kill him, and then go home to your bed and nothing happens," she said.

During the weekend, volunteers in the black community hastily worked to complete a modest memorial of stuffed animals, cards and crosses in time to remember the first anniversary of Martin's shooting. It has also become a way for Sanford to remember the many other black victims of violence whose stories largely went untold.

City Manager Norton Bonaparte, who is black, said Sanford had begun to tackle deep-seated problems between police and the black community that were exposed in public forums after Martin's death.

"In honoring Trayvon's life, we have to make ourselves a better community," Bonaparte said.

The police chief at the time of Martin's shooting lost his job over criticism that his department and prosecutors chose not to charge or arrest Zimmerman.

The new chief starts his job in April.

"Now, it's like the police are getting more involved in being with the community," Philemon said. "They are starting to do their part in interacting with us. They say there is not as many shootings as there once was."

Another resident, Thelma Holmes, 62, agreed saying, "It is better than what it was before, because we had a lot of killings of young men ... The people and the police, they're both trying."

Trayvon's death will not be forgotten.

"It started people to come forward. So his death is not going to be in vain," Philemon said. "And he will always be remembered."

Martin's parents and lawyers will be in New York City, not Sanford, to hold a candlelight vigil on Tuesday night.

Zimmerman, who is charged with second-degree murder, was granted bond and ordered to surrender his passport, agree to be electronically monitored, reside in Seminole County, and observe a nighttime curfew.

White House steps up campaign to avoid spending cuts

WASHINGTON (Reuters) - The White House escalated a campaign on Monday to convince Americans dire consequences await if government spending cuts go ahead on March 1, warning of a slow down in global trade, a stalled fight against cancer and Alzheimer's disease and compromised security at U.S. borders.

At the same time, prominent Republicans said President Barack Obama was overstating the potential damage of the $85 billion in government-wide cuts to frighten the public.

"There is a responsible way to cut less than 3 percent of the federal budget. It's time for the president to show leadership," Louisiana Governor Bobby Jindal told reporters after a meeting between the president and governors. "The president needs to stop campaigning, stop trying to scare the American people."

Jindal's comments followed the president's plea for Republican and Democratic governors to press Congress to stop the cuts, telling them he was willing to compromise with Republican lawmakers.

But the president gave no sign that he would try to start negotiations or take steps to blunt the effect of the cuts. He bemoaned what he described as a confrontational atmosphere in Washington, where budget battles have provoked one near crisis after another since the summer of 2011.

In recent weeks the White House has sought to highlight in stark terms the disruptions that would begin on Friday if federal programs are cut.

On Monday, Homeland Security Secretary Janet Napolitano warned the cuts would increase delays at ports of entry into the United States for container cargo by "up to five days."

Average wait times at customs for travelers will increase "by as much as 50 percent," she added, with even longer delays at the busiest airports such as Newark, Los Angeles and New York's JFK where delays could double to "four hours or more."

"I'm not here to scare people, I'm here to inform," Napolitano said at a White House briefing. "Please don't yell at the customs officer or the (Transportation Security Administration) officer because the lines are long," she said. "The lines over the next few weeks are going to start to lengthen in some dramatic ways in parts of the country."

Also Monday, Francis Collins, director of the National Institutes of Health, told reporters that the $1.6 billion cutback would hit the 240-bed NIH Clinical Center in Bethesda, Maryland, where doctors study rare diseases and conduct clinical trials to test new drugs for conditions ranging from cancer and AIDS to depression and genetic disorders.

The NIH also predicted that a lack of funding for hundreds of new grants could jeopardize as many as 20,000 research jobs across the United States and slow vital projects to fight cancer and Alzheimer's disease, develop a universal influenza vaccine and gain fresh insights into the activities of the human brain.

The administration began ratcheting up its warnings on Friday when Transportation Secretary Ray LaHood described cuts at airports that he said would cause domestic air travelers significant delays.

Over the weekend, the White House distributed state-by-state projections of lost jobs and cuts in education funding for poor children. These figures were widely reported on local news broadcasts.

HOW LONG WILL CUTS LAST?

The actual impact of the cuts will depend largely on how long they last.

Many of the projections are based on the likelihood that government employees will be furloughed - told to take unpaid days off - in order to meet the demands of the cuts.

But the furloughs won't occur for at least a month, or perhaps later, because federal rules require the government to give its employees 30-days notice.

Congress and the White House also could agree to stop or ease the cuts before they run their course.

Neither the White House nor members of Congress have offered reason to hope for a deal before Friday's deadline.

Asked Monday whether he thought the automatic cuts, called "sequestration" in Washington-speak, would take effect, House Speaker John Boehner, a Republican, responded: "hope springs eternal."

Both sides have concentrated more in recent days on apportioning responsibility for the spending reductions, to which both sides agreed in August 2011 with the expectation that the sequestration would never come to pass.

The White House public relations initiative has increasingly drawn criticism from Republicans who accuse the president of exaggerating and traveling around "campaigning" instead of looking for ways to avoid the cuts.

"We heard the president say last week that he was going to be forced because of the sequestration to let criminals loose on the street if he didn't get another tax hike," House Majority Leader Eric Cantor told reporters Monday.

"Today, we're hearing discussions from the Secretary of Homeland Security that somehow we're going to have to sacrifice homeland security efforts and keeping our country safe if we don't get another tax hike. This is a false choice."

White House press secretary Jay Carney responded Monday that the administration is just trying to "highlight the impact of sequester, and by doing so, hope that attention will be brought to bear on that problem, and the need for Congress to act responsibly to avoid it."

Obama is scheduled to travel to Cantor's state of Virgina on Tuesday, to press his case at the Newport News shipyard. The cuts fall evenly on non-defense and defense spending, with states like Virginia, heavily dependent on Pentagon contracts, expected to be hardest hit.

Issue One: The State of the Union

The jobs focus

President Barack Obama's State of the Union address held solid expectations for the nation's work force.

No city can identify more with the vision to be a "magnet for manufacturing" than Pittsburgh. Prolific opportunities exist with the Marcellus Shale and through growth in the energy and health care sectors. Three Rivers Workforce Investment Board, in partnership with the business, philanthropic and education community, is preparing a work force for the jobs of today and tomorrow.

The president mentioned how Germany ensures a tie between the high school diploma and a technical degree from a college to make students ready for jobs. I recently visited Germany to learn firsthand how the country creates a pipeline of skilled workers, and we're now developing similar approaches through our Making It in America federal work force innovation grant program -- using labor union know-how to give people new skills to support domestic commercialization of innovative start-up manufacturers.

Three Rivers WIB also is rethinking the youth development system to ensure that we know the resources we invest in youth services are of high quality, highly effective and aligned with research-based youth development principles. We agree, "It's not a bigger government we need, but a smarter government." We encourage every youth to imagine a career and participate in a paid work experience.

The Pittsburgh region is adding jobs at great speed, "but none of it will matter unless we also equip our citizens with the skills and training to fill those jobs." Well said, Mr. President. That's where we come in.

Empty promises

Any reader who would take the time to parse the priorities of the State of the Union speech by the president outlined in your Feb. 14 editorial ("Second Act: Obama Lays Out an Ambitious Set of Priorities") would have no trouble seeing the duplicity of them. Many of the goals have been stated as promises by the president as a candidate and first-term president, only to be forgotten and ignored as the "same old, same old."

If the president could really show the leadership you claim at the end of the piece, he would be pragmatic and foster the bipartisanship he neglects to show. Perhaps he should finally stop campaigning and start governing.

Mobile World Congress (MWC) officially kicks off on Monday, but there are MANY things to see in the booths on the floor and much speculation; something we writers do best.? Engadget posted a couple pictures that we are passing on for your enjoyment.? They also stated the obvious, the Galaxy Note 8 ?almost hides your entire hand,? making fun of the Note 2, no doubt; but that?s okay, we can take it.

From these pictures, we can clearly see the Menu and Back Capacitive buttons, but it is hard to tell if there is a physical Home button.? Some speculate that a physical Home button is there, and if that is true, then Galaxy Note 8 would basically be a stretched out Note 2.

The rumored specs for the Galaxy Note 8 are as follows:

1 ? 8-inch 1280 x 800 display

2 ? 1.6GHz quad-core Exynos 4 processor

3 ? 2GB of RAM

4- 16/32GB Internal Storage, expandable via a microSD card

It is a Galaxy Note, so expect the S-Pen, Multi-Windows, and apps that go with the Note series.? Not much else is known at this time, but we will keep you posted as we find out more facts or fiction.? Are you excited about the Galaxy Note 8?

The lineup has definitely kept its sporty, skater-esque stylings, but the internals seem to be improving. The recent Skullcandy Navigator<span></span>?is a solid, bass-friendly budget option, and the Hesh 2, starting at $69.95 (direct) for models with the inline remote, offers a refined sound signature that is crisp and relatively balanced. Plus, the audio is delivered distortion-free, with an emphasis on mid-range and high frequency clarity.</p> <p><strong>Design<br /></strong>No Skullcandy product would be complete without multiple style options, paint jobs, and price tiers. The Hesh 2, with no mic and black-on-black design, sells for $59.95 (direct). Add in the inline mic and phone controls, and the lowest pricing is $69.95. Then, of course, you can buy a pair that has your favorite team's logo on it, or one that is covered in hemp. Those range from $79.95 and up.<strong></strong></p><p>Given all of the above, it's almost pointless to discuss the overall look of the Hesh 2, since it is basically a chameleon that comes in several styles and flavors. The overall shape doesn't really change, however?a simple, padded headband meets circular ear cups that also protrude outward, taking the shape of globes sliced in half.</p> <p>The circumaural (around the ear) design of the Hesh 2 can feel a little rigid and awkward, as if the ear cups are a bit too small to fit an entire ear inside them. It's not uncomfortable, really, just awkward?the cups would probably be better served if they were either a bit larger, our more appropriately matched to an ear's shape, and not perfect circles. Regardless, the headphones are quite lightweight and don't grow uncomfortable during longer listening sessions.<img alt="Skullcandy Hesh 2 inline" border="0" class="right" src="http://www4.pcmag.com/media/images/375885-skullcandy-hesh-2-inline.jpg?thumb=y" /></p> <p>The Hesh 2, as previously mentioned, is available with or without the inline remote and microphone. Call clarity through the mic is not astounding, but your call partner will understand you and you'll understand them. In other words, you're dealing with typical low-fi cellular fidelity.</p> <p>One nice perk: the cable is detachable. This adds value to your purchase; replacing a faulty cable is far cheaper than buying an entire new pair of headphones or sending things in for repair, and cables are the most common culprit when headphones malfunction. Finally, a black drawstring bag is included with the Hesh 2.</p> <p><strong>Performance<br /></strong>The Hesh 2 does not distort on tracks with deep bass, even at high volumes. Its overall response is limited in the sub-bass realm. It does reproduce truly deep frequencies, but not with the same amount of gusto as, say, the Beats by Dr. Dre<span></span>. The Knife's "Silent Shout," which has tremendous sub-bass content, can be played at maximum (and unsafe) volume without distorting, and you will get a good sense of the intensity of the bass, but this is not a deep bass lovers dream. However, bass fiends on a budget won't feel ripped off. Like some studio monitor-style headphones, the Hesh 2 provides a clear picture without ignoring or overly boosting the lows.</p> <p>The focus for the Hesh 2 seems to be more on the mids and highs. It's nice to see a manufacturer focus on this realm when it's clear the drivers could have been tweaked to push out gobs of heavy, deep sub-bass. The end result here is the bass is dutifully represented?the new Atoms for Peace record, <em>Amok</em>, doesn't sound brittle in the slightest, and Flea's bass lines and the deep bass synth parts are delivered with richness and clarity. But the real standout feature of the sound signature is the clarity and crispness of the vocals and the attack of the percussion. Things aren't overly bright, but vocals are delivered with a nice edge to them, snare drums have a pleasing snap, and there's no part of the mix you can't hear. As previously stated, the Hesh 2, whether this was intentional or not, reminds me of a studio monitor pair, like the Sennheiser HD 280 Pro<span></span>.</p> <p>Bill Callahan's vocals on "Drover" have a nice treble presence that helps his voice stand out in a mix featuring some heavy backing percussion. The drumming itself has a subtle bass presence, rather than an overly-boosted thunderous sound, which can often occur on budget pairs that boost the low frequencies too much. The Hesh 2 also tames the intense sub-bass synth hits on Jay-Z and Kanye West's "No Church in the Wild," while highlighting the hi-mid attack of the kick drum loop and helping the vocals take center stage.</p> <p>On classical tracks, like John Adams' "The Chairman Dances," the Hesh 2 fares less well. Here, it does sound a bit tinny and brittle. The lower register strings are nicely represented, but the higher register instruments seem to have a bit too much edge on them, which more or less cancels out the subtle bass response. It doesn't sound horrible by any stretch of the imagination, especially for this price range, but the Hesh 2 is perhaps better suited for pop, rock, hip hop, and electronic genres, for which it manages to tame the more intense elements of the mix, like throbbing bass, while highlighting aspects that sometimes get lost in busy mixes, like vocal clarity.</p> <p>The idea of the "bass lover" is a curious thing. I love bass, for instance, when it's accurate, or slightly boosted. I don't want insanely-boosted low frequencies to gobble up the whole mix and vibrate my skull, but I do love when sub-bass frequencies jump out in the mix a bit. The Hesh 2 does a great job of allowing sub-bass elements to exist in a sound signature that is otherwise focused on hi-mids and highs. So, bass fiends may or may not love the Hesh 2, but if your looking for a fairly accurate, affordable headphone pair, especially for modern music mixes, it's a great place to begin your search.</p> <ziffshop id="38542" readability="16.2798708288"><p>If you have a bit more cash to spend and want to stick with this same overall sound signature, the aforementioned Sennheiser HD 280 Pro is a fantastic option, though it's a bit bulky and intended for studio use. The Logitech UE 4000<span></span>?also delivers distortion-free performance with sub-bass presence that isn't overly-boosted. It's priced a bit higher, as well, but a worthy step up if you have the budget. If you really do want to hear some seriously boosted bass, of course there are plenty of options, including Skullcandy's own Navigator, which focuses more on the lower frequencies than does the Hesh 2. For the price, however, the Hesh 2 offers a clear, distortion-free experience. It's by no means a masterpiece, but definitely a solid value.</p> <p><em>More Headphone Reviews:<br /></em><span>??? Despite his conservative religious stance, the Pope was the first to embrace the digital age by opening up a Twitter account. What?s to come of @Pontifex now that he?s no longer the Pope? Vatican Radio announced that his Twitter account would be shut down.</p><p>The 1.5 million users that are following the Pope will be following one less person by 8 PM Vatican Time (CET) time on February 28, which coincides with the official exit from his position. Vatican Radio says that he?ll send out a final tweet before then.</p><p>The Pope is following eight other accounts ? the Pope?s Twitter account in different languages including Italian, French, Arabic, and six others (including English of course). These accounts, which have a combined total of 1.3 million followers, will be also shut down.</p><p>?It seems unimaginable that one could continue to use a communication tool so popular and powerful during the ?sede vacante? period,? Vatican Radio said.</p><p>The Pope opened his Twitter account, which means ?Pope? and ?bridge builder,? in December. The lifespan of the account is coming to an end after just two months and at the time of this writing has just 36 tweets. Since the account was maintained by his papal aids over at the Vatican, and signed off by him, there may be no one to maintain the account anyway unless Joseph Aloisius Ratzinger (Benedict XVI?s birth name) decides to take up the @Pontifex Twitter account on his own.</p><p>The reason for the Pope?s resignation is left up for debate, and there are plenty of speculating in the media, the next Pope who is to succeed Benedict XVI, hasn?t been appointed yet. The Vatican Cardinals will be voting for the next Pope starting between 15 and 20 days once he resigns from his post on the 28th. We have to wonder if the next Pope would be interested in opening up a Twitter account for himself. And since the current account isn?t personalized, but rather ?refers to the person of the pope,? there?s no reason why it couldn?t be assumed by whoever assumes the position.</p><p>According to Italian news agency ANSA, The Vatican says that every moment from of Benedict XVI?s last day will be recorded. As a result, the new owner of the 1865 Iowa home, Sherri Meeker, had the 100-ton structure moved five miles down the road.</p> <p>Naturally, it caught the interest of the Web. The old house, supposedly haunted by evil spirits, bears a resemblance to the one on ?Nightmare on Elm Street? and is known around town as the "Haunted Mansion of Jasper County."</p> <p>Some locals swear it has a spooky past. The three-story, wood-frame house sure looks haunted. Local news station KCCI even spent the night there in 1994 after hearing lots of stories about Regina Long, thought to be the original owner, who was said to float around it. Mike Salier, the homeowner at the time, said in the KCCI story: ?It's real. People think it's a lot of poppycock, but it's enough to make your skin crawl.?</p> <p>The stories certainly were enough to get the Web buzzing over footage of the 150-year-old house slowly making its way down the road.</p> <p>Of course, believers of the spooky tales are wondering if the spirits will pick up and move, or haunt the next structure that goes up in its place.</p> <p>At the very least, it would make a good movie. "These parts do not pose a safety risk to soldiers relying on our vehicles. The U.S. government recently verified their quality and our manufacturing process, and has since closed the matter."</p><p>The lawsuits were filed in U.S. District Court in New Orleans on Tuesday and Wednesday. Alliance has not yet filed a formal response in court. A woman who answered the phone at Alliance's office on Friday said the company had no comment.</p><p>In his lawsuit, Williams said he welded several parts later installed in Textron's M1117 trooper carrier vehicles -- blast windows, battery boxes, and grenade launchers, among other components. He claims no employee at Alliance Laser, including himself, was certified to weld those parts, as required by law.</p><p>Williams claims he told his supervisor, Jeremy Noller, that the techniques being used by the uncertified welders made all of Allianice's parts defective.</p><p>Alliance's quality control inspectors placed red tags on many defective parts, but company supervisors later removed those tags, allowing defective parts to be shipped to Textron, the lawsuit claims. Company officials then presented false records and made false statements to Textron that the parts had been approved by inspectors, the lawsuit claims.</p><p>"Upon information belief, U.S. soldiers have been injured due to Alliance's provision and concealment of defective M1117 parts," the lawsuit says.</p><p>According to the lawsuit, Noller told Williams that "if Williams' house was blown up, Williams' body would not be found, and Williams could not testify against Noller or Alliance." Williams was fired on Sept. 8, 2012.</p><p>Williams offered information to the FBI, the U.S. Attorney's Office, the U.S. Department of Defense and the U.S. Attorney General "to assist their investigation into Alliance's violations of Louisiana and federal laws," the lawsuit says.</p><p>Vargas, a former quality control inspector, claims in his lawsuit that he was fired on April 18, 2012, for reporting defective welding work and refusing to approve parts that were ultimately sold to Textron. He claims that Alliance officials removed his red tags marking defects and covered up faulty cracks with filler, sandblasting and paint. Unlike in earlier rounds of budget brinkmanship, President <span class="yshortcuts" id="lw_1361623987617_1">Barack Obama</span> and <span class="yshortcuts" id="lw_1361623987617_2">congressional Republicans</span> both seem content to fight out their latest showdown on the current terrain, let across-the-board spending cuts take effect on March 1 and allow them to stay in place for weeks if not much longer.</p> <p>This time, there is no market-rattling threat of a government default to force the two sides to compromise, no federal shutdown on the short-term horizon and no year-end deadline for preventing a tax increase for every working American.</p> <p>The rhetoric is reminiscent, for sure.</p> <p>"So far at least, the ideas that the Republicans have proposed ask nothing of the wealthiest Americans or the biggest corporations," Obama said this week as he campaigned to pin the blame for any negative effects on his political opponents. "So the burden is all on the first responders, or seniors or middle class families," he said in comments similar in tone to his re-election campaign.</p> <p>Republicans, standing on political ground of their own choosing, responded sharply to the president's fresh demand for higher taxes.</p> <p>"Spending is the problem, spending must be the focus," said <span class="yshortcuts" id="lw_1361623987617_4">House Speaker John Boehner</span> of Ohio, while Senate GOP leader Mitch McConnell of Kentucky declared, "There won't be any easy off-ramps on this one. The days of 11th hour negotiations are over."</p> <p>A crisis atmosphere could yet develop this spring, when hundreds of thousands or even millions of threatened <span class="yshortcuts" id="lw_1361623987617_6">government</span> furloughs begin to take effect and the spending cuts begin to bite. Already, Republicans are considering legislation to give the administration greater flexibility in making the cuts, a step that could minimize the impact on the public. It's a step the <span class="yshortcuts" id="lw_1361623987617_3">White House</span> says it opposes, although the depth of that conviction has yet to be tested.</p> <p>At heart, the standoff is yet another indication of the political resistance to a compromise curbing the growth of Medicare, Medicaid and possibly Social Security, a step that both Obama and Republicans say is essential to restoring the nation's fiscal health. It is the last major remaining challenge in divided government's struggle, now in its third year, to reduce deficits by $4 trillion or more over a decade.</p> <p>Counting the across-the-board cuts now beginning to command the nation's attention ? at a 10-year cost of $1.2 trillion ? the president and Congress have racked up more than $3.6 trillion in savings. Much came from spending, although legislation that Republicans let pass at year's end raised taxes on the wealthy to generate an estimated $600 billion for the Treasury over a decade.</p> <p>The so-called sequester now approaching was never supposed to happen. It was designed as an unpalatable fallback, to take effect only in case a congressional super-committee failed to come up with $1 trillion or more in savings from benefit programs.</p> <p>Now, more than a year later, <span class="yshortcuts" id="lw_1361623987617_5">Republicans</span> are fond of saying that the idea itself originated at the White House.</p> <p>That skips lightly over the fact that their own votes helped enact it into law.</p> <p>Also that they decided a month ago that it marked the moment of most leverage in their struggle to maneuver Obama and Democrats into curtailing benefit programs. To accomplish that objective, they already have raised the debt limit without winning any cuts in exchange, a step they once vowed not to take. And within two weeks, they are likely to launch legislation making sure the government operates without interruption when current funding authority runs out for most agencies on March 27.</p> <p>Republicans aren't the only ones partial to verbal sleights of hand.</p> <p>In a letter to lawmakers earlier this month, Health and Human Services Secretary Kathleen Sebelius sounded a series of alarms. The spending cuts "could compromise" the health of more than 373,000 mentally ill or emotionally disturbed individuals, "could slow efforts to improve" health care for American Indians and Alaska Natives, she wrote, and admissions to inpatient addiction facilities "could be reduced."</p> <p>Could or could not. Soon or later. Nothing pinned down.</p> <p>The administration hopes to win over the public and bring Republican lawmakers to heel, and it dispatched Transportation Secretary Ray LaHood to the White House briefing room on Friday.</p> <p>"Come to the table and start talking" to find a way to avert the cuts, the former GOP lawmaker urged members of his own Republican Party.</p> <p>Peppered with skeptical questions, LaHood directed reporters to his department's website, with a listing of more than 300 air traffic facilities where overnight shifts could be eliminated or perhaps closed entirely.</p> <p>Asked if his office was receiving unhappy calls from the public, he got to the political point.</p> <p>"My phones will ring from members of Congress (asking) 'why is my control tower being closed?'" he said.</p> <p>___</p> <p>EDITOR'S NOTE ? Edson Endrigo, our nature guide extraordinaire, was explaining his technique for spotting giant anteaters in Serra da Canastra National Park, just one of the rarities in this area. Obediently looking up on the hillside, I spotted a two-meter-long mobile banana. We jumped out of the van and circled behind a female anteater with a baby clinging to her back. My two companions, David Wilcove and John Morrison, and I closely tracked her progress.</p> <p> If the greater one-horned rhino seems odd and prehistoric, the giant anteater offers good company as one of the most peculiar-looking mammals on the planet. Both are ranked as threatened on the IUCN Red List of Threatened Species. The <em>tamandua-bandeira</em>, or <em>papa-formigas</em>, as it is known in Brazil, cuts a comical figure, sporting an elongate, arching snout and bowlegged limbs, all ending in an immense shaggy tail. The rest of the body is shaggy, too, featuring a striking long pelage of dark bands on light. The female in front of us moved along like an animated throw rug.</p> <p> An anteater walks on thickened pads on the outsides of its paws, as its digits are turned under its feet. An observer might think of this awkward creature, with its poor eyesight, bad hearing, and odd gait, as defenseless against secretive jaguars and pumas. That would be a miscalculation. With its acute sense of smell, the anteater can make up for its nearsightedness. If cornered, it will stand up on its hind legs and slash with its massive claws any human or feline predator foolish enough to tangle with it.</p> <p> The mama anteater stopped and flicked her tongue in the dirt. Unlike the vast majority of mammals, the giant anteater lacks teeth. It has no real need for them because it inserts its long, narrow tongue into crevices, removes ants and termites with its sticky saliva, and swallows them whole. Crouching downwind, I inhaled deeply to catch its scent and wondered if consuming 30,000 ants a day gives this creature, or its flatulence, the odor of formic acid. I smelled nothing unusual.</p> <p> *</p> <p> Human activities sometimes bring species back from the brink of extinction. But more often they exacerbate rarity even to the point of disappearance, drive into rarity species once common, or further constrain those species that normally have narrow ranges or live at low densities. The most dramatic change happening today that is pushing already uncommon species toward even greater rarity is the conversion of rain forests and natural savannas into commodities production for industrialized agriculture. Big Ag, as it is now known, is largely mechanized, highly profitable, and controlled by multinational corporations. Some biologists and geographers describe extension of this trend as the future; increasingly, we live on a cultivated planet. The loss of natural habitats through nonagricultural use?that is, human settlements?and in nontropical areas is also high, but the conversion is greatest in the tropics and through big agriculture.</p> <p> Few field biologists bother to check the daily price of soybeans or palm oil. This is an oversight because the market value of these commodities?along with that of beef, corn, sugar, and coffee?may over the coming decades define the future of rare species more profoundly than will any other driver of habitat loss. At present, nowhere is the conversion and fracturing of rain forests by industrialized agriculture in the world?s hotbeds of rarity more evident than in Southeast Asia and Brazil. In Kalimantan and Sumatra, Indonesia, expansion of oil palm and wood pulp plantations threatens the most species-rich rain forests in the world. In Brazil, vast areas of the Amazon are turning into cattle ranches and soybean farms. In addition to causing habitat loss, such rampant conversion imperils climate stability. You?ll have to arm our people,?? Kelly said.</p> <p class="NormalParagraphStyle">CTA rail workers should get special training if they have to carry guns and should be paid extra for doing so, Kelly said.</p> <p class="NormalParagraphStyle">The Illinois House Judiciary Committee has scheduled a hearing on the concealed carry issue at 10 a.m. Friday in Room 600 of the Bilandic Building, 160 N. Few expect the case, seen lasting several months, will be decided by the judge.</p><span id="midArticle_2"></span><p>An eleventh-hour settlement this weekend is a possibility, but legal experts expect a resolution, at least with the U.S. Department of Justice, in the coming months. Early testimony is likely to set the tone for any settlement talks, depending on how damaging the evidence is, they said.</p><span id="midArticle_3"></span><p>"This is a game of corporate chicken," said John Zavitsanos, a Houston civil litigator. "We have tangled with BP often, and they blink."</p><span id="midArticle_4"></span><p>Joining well owner BP Plc in Judge Carl Barbier's courtroom will be rig owner Transocean Ltd and well cement services provider Halliburton Co.</p><span id="midArticle_5"></span><p>Lined up against them will be the Justice Department, several Gulf Coast states and other plaintiffs.</p><span id="midArticle_6"></span><p>BP has a history of settling civil cases before or during trial. Four trials began over the 2005 explosion at its Texas City refinery that killed 15 people. All were settled. Payouts totaled $3.1 billion. BP has since sold the refinery.</p><span id="midArticle_7"></span><p>The stakes are higher this time, though. The Macondo well explosion and spill on April 20, 2010 affected five state coastlines, prompted a six-month ban on oil and gas drilling in the Gulf and disrupted the livelihoods of fishermen, hoteliers and others. And once a trial gets under way, a new dynamic can take hold.</p><span id="midArticle_8"></span><p>"If the first couple of days are good for the plaintiffs or good for the defendants, that could shift. Once the first pitch is thrown, those odds could change," said Anthony Sabino, a business law professor at St. John's University School of Law.</p><span id="midArticle_9"></span><p>Just ahead of the trial, BP won agreement from the Justice Department to exclude 810,000 barrels from the total spilt barrels estimate, but BP says the estimate is still too high. It also wants "efforts to do the right thing" afterwards taken into account and has earmarked only $3.5 billion for Clean Water Act payments, compared with its potential maximum liability of $17.5 billion.</p><span id="midArticle_10"></span><p>A BP settlement with the Justice Department over such a large liability could lead to another delay of a trial that has already been postponed.</p><span id="midArticle_11"></span><p>"With the federal government out of it, he (Barbier) might well postpone ... particularly if the states indicated to him that they were continuing to talk," said Ed Sherman of Tulane University Law School in New Orleans.</p><span id="midArticle_12"></span><p>"REASONABLE TERMS"</p><span id="midArticle_13"></span><p>BP has already paid out $9 billion in a partial settlement over the spill. Last year it also settled 14 criminal charges with a guilty plea and a record $4 billion in fines and penalties.</p><span id="midArticle_14"></span><p>The civil claims to be covered next week could surpass these, and the trial's significance to BP was evident at a February 5 news conference in London. When Chief Executive Bob Dudley said the company would vigorously defend itself, he repeatedly looked toward his top in-house lawyer, Rupert Bondy, for moral support.</p><span id="midArticle_15"></span><p>BP has repeatedly said it will settle on "reasonable terms," but Bondy drew a line in the sand this week, saying the British company now goes to trial "faced with demands that are excessive and not based on reality."</p><span id="midArticle_0"></span><p>Its spill bill is already impressive: Accounting provisions total $42 billion - about 30 percent of its stock market value. It has sold assets worth $38 billion to finance compensation, clean-ups and fines. It has paid, or committed to pay, $37 billion of this. The actions have sliced $5 billion a year, or 14 percent, off its cash flow - a basic money-making measure.</p><span id="midArticle_1"></span><p>And there is more to come. That is why, even on forward measures of earning power, a shrunken BP still lags its peers.</p><span id="midArticle_2"></span><p>If BP is found "grossly negligent" - a key question for the trial - its fine under the U.S. Clean Water Act could be as high as $17.5 billion based on a total of 4.1 million barrels spilled and a maximum fine of $4,300 a barrel.</p><span id="midArticle_3"></span><p>It could also be much lower, at a maximum $1,100 per barrel, or $4.5 billion, if BP's claim that it was "no more than negligent" is proved.</p><span id="midArticle_4"></span><p>Aside from the Clean Water Act, two other claim groups come under the jurisdiction of Barbier, a federal judge for the Eastern District of Louisiana. Both are harder to quantify.</p><span id="midArticle_5"></span><p>Economic damage claims totaling $34 billion have been made by Gulf Coast states including Louisiana and Alabama. BP has said these are excessive, and that its clean-up spending had a positive economic impact.</p><span id="midArticle_6"></span><p>A third set of claims, for natural resources damage, has not even been quantified yet.</p><span id="midArticle_7"></span><p>PROVING GROSS NEGLIGENCE</p><span id="midArticle_8"></span><p>From Monday, phase one of the trial will focus on the level of negligence and on apportioning blame among the defendants.</p><span id="midArticle_9"></span><p>Phase two will focus on the number of barrels spilled from the blown-out well.</p><span id="midArticle_10"></span><p>Together, they could drag into next year, and neither phase will consider the size of any fine. But a gross negligence finding could open the way for extra costs in the form of punitive damages.</p><span id="midArticle_11"></span><p>Experts point out that strong evidence of a reckless and willful disregard for employee safety and environmental health would be required to prove gross negligence.</p><span id="midArticle_12"></span><p>"It is very difficult to prove, and that is something that these defendants are counting on," Sabino said.</p><span id="midArticle_13"></span><p>Zavitsanos cited the 1970 Ford Pinto Memo as one of the few cases where the evidence was strong enough to prove gross negligence. In this case, Ford Motor Co was shown to have been aware of a design flaw and that a crash could puncture the gasoline tank and cause a fire. It was also shown to have decided to risk death and injury lawsuits rather than fix the design.</p><span id="midArticle_14"></span><p>Steve Herman, one of the lead lawyers for the plaintiffs, said they contend there is "overwhelming evidence" that BP, Transocean and Halliburton "were all grossly negligent, and we look forward to laying bare that evidence for all to see."</p><span id="midArticle_15"></span><p>Alabama Attorney General Luther Strange, who will speak for the states in the trial, agreed that the evidence would show BP's conduct reaches the level of gross negligence and said expert testimony would prove "very, very damaging to BP."</p><span id="midArticle_0"></span><p>Strange plans to pummel BP with declarations that the spill was both predictable and preventable, and that the company fosters a "culture of callousness."</p><span id="midArticle_1"></span><p>"It's a focus of profits over safety," he said in an interview on Thursday.</p><span id="midArticle_2"></span><p>The companies have consistently held that whatever mistakes were made, they don't rise to the level of gross negligence.</p><span id="midArticle_3"></span><p>The case is In re: Oil Spill by the Oil Rig "Deepwater Horizon" in the Gulf of Mexico, on April 20, 2010, No. 10-md-02179, in the U.S. District Court, Eastern District of Louisiana.</p><span id="midArticle_4"></span><p>(Additional reporting and writing by Andrew Callus; By analyzing Mercury's rocky surface, scientists have been able to partially reconstruct the planet's history over billions of years. Now, drawing upon the chemical composition of rock features on the planet's surface, scientists at MIT have proposed that Mercury may have harbored a large, roiling ocean of magma very early in its history, shortly after its formation about 4.5 billion years ago.</p> <p>The scientists analyzed data gathered by MESSENGER (MErcury Surface, Space ENvironment, GEochemistry, and Ranging), a NASA probe that has orbited the planet since March 2011. Later that year, a group of scientists analyzed X-ray fluorescence data from the probe, and identified two distinct compositions of rocks on the planet's surface. The discovery unearthed a planetary puzzle: What geological processes could have given rise to such distinct surface compositions?</p> <p>To answer that question, the MIT team used the compositional data to recreate the two rock types in the lab, and subjected each synthetic rock to high temperatures and pressures to simulate various geological processes. From their experiments, the scientists came up with only one phenomenon to explain the two compositions: a vast magma ocean that created two different layers of crystals, solidified, then eventually remelted into magma that then erupted onto Mercury's surface.</p> <p>"The thing that's really amazing on Mercury is, this didn't happen yesterday," says Timothy Grove, a professor of geology at MIT. "The crust is probably more than 4 billion years old, so this magma ocean is a really ancient feature."</p> <p>Grove, along with postdoc Bernard Charlier and Maria Zuber, the E.A. Griswold Professor of Geophysics and Planetary Science and now MIT's vice president for research, published the results in the journal <em>Earth and Planetary Science Letters</em>.</p> <p><strong>Making Mercury's rocks</strong></p> <p>MESSENGER entered Mercury's orbit during a period of intense solar-flare activity; as the solar system's innermost planet, Mercury takes the brunt of the sun's rays. The rocks on its surface reflect an intense fluorescent spectrum that scientists can measure with X-ray spectrometers to determine the chemical composition of surface materials.</p> <p>As the spacecraft orbited the planet, an onboard X-ray spectrometer measured the X-ray radiation generated by Mercury's surface. In September 2011, the MESSENGER science team parsed these energy spectra into peaks, with each peak signifying a certain chemical element in the rocks. From this research, the group identified two main rock types on Mercury's surface.</p> <p>Grove, Charlier and Zuber set out to find an explanation for the differences in rock compositions. The team translated the chemical element ratios into the corresponding building blocks that make up rocks, such as magnesium oxide, silicon dioxide and aluminum oxide. The researchers then consulted what Grove refers to as a "pantry of oxides" -- finely powdered chemicals -- to recreate the rocks in the lab.</p> <p>"We just mix these together in the right proportions and we've got a synthetic copy of what's on the surface of Mercury," Grove says.</p> <p><strong>Crystals in the melt</strong></p> <p>The researchers then melted the samples of synthetic rock in a furnace, cranking the heat up and down to simulate geological processes that would cause crystals -- and eventually rocks -- to form in the melt.</p> <p>"You can tell what would happen as the melt cools and crystals form and change the chemical composition of the remaining melted rock," Grove says. "The leftover melt changes composition."</p> <p>After cooling the samples, the researchers picked out tiny crystals and melt pockets for analysis. The scientists initially looked for scenarios in which both original rock compositions might be related. For example, both rock types may have come from one region: One rock may have crystallized more than the other, creating distinct but related compositions.</p> <p>But Grove found the two compositions were too different to have originated from the same region, and instead may have come from two separate regions within the planet. The easiest explanation for what created these distinct regions, Grove says, is a large magma ocean, which over time likely formed different compositions of crystals as it solidified. This molten ocean eventually remelted, spewing lava onto the surface of the planet in massive volcanic eruptions.</p> <p>Grove estimates that this magma ocean likely existed very early in Mercury's existence -- possibly within the first 1 million to 10 million years -- and may have been created from the violent processes that formed the planet. As the solar nebula condensed, bits and pieces collided into larger chunks to form tiny, and then larger, planets. That process of colliding and accreting may produce enough energy to completely melt the planet -- a scenario that would make an early magma ocean very feasible.</p> <p>"The acquisition of data by spacecraft must be combined with laboratory experiments," Charlier says. "Although these data are valuable by themselves, experimental studies on these compositions enable scientists to reach the next level in the interpretation of planetary evolution."</p> <p>Larry Nittler, a staff scientist in the Department of Terrestrial Magnetism at the Carnegie Institution of Washington, led the research team that originally identified the two rock compositions from MESSENGER data. He says the MIT team's experimental results propose a very likely early history for Mercury.</p> <p>"We're gradually filling in more blanks, and the story may well change, but this work sets up a framework for thinking about new data," says Nittler, who was not involved in the study.
